1. Introduction

Welcome to OTOZ, a mobile application that allows users to list and discover cars for sale. By creating an account or using the app, you agree to be bound by these Terms & Conditions and our Privacy Policy.

If you do not agree with these terms, please stop using the app.

2. Nature of the Service

OTOZ is only a listing platform.

We do not own, inspect, buy, sell, or deliver cars, and we do not get involved in negotiations or payments.

All transactions happen directly between the buyer and the seller.

OTOZ is not responsible for:

  • Car condition
  • Car accuracy or description
  • Payment safety
  • Meeting arrangements
  • Fraud, scams, or disputes

Users must verify all details and check the car before buying.

Dealers may use OTOZ to publish showroom listings and manage leads. The same rules apply — OTOZ is not a party to any sale.

3. User Accounts

To use OTOZ, you must create an account and provide accurate information, including:

  • Your name
  • Your phone number
  • Your location (city/area)

Sign-in is via one-time SMS code to your Iraqi phone number (+964); we do not require a password.

You are responsible for:

  • Keeping your account secure
  • Ensuring your contact information is correct
  • Any activity that happens under your account

We may suspend or remove accounts that violate these Terms.

4. Information We Collect

When using OTOZ, we collect and store:

  • Name
  • Phone number
  • City/location
  • Car listing details (make, model, year, mileage, price, description)
  • Uploaded photos of the car

We may request permission to access your camera or photo gallery only for uploading car images.

OTOZ does not collect payment information and does not process transactions.

5. Posting a Car Listing

By listing a car, you confirm that:

  • You own the vehicle or have permission to sell it
  • All information in the listing is accurate and truthful
  • The photos you upload belong to you
  • The vehicle is not stolen and all documents are valid

We may remove any listing that appears false, misleading, illegal, or violates our policies.

6. User Responsibilities

Users must:

  • Use the app lawfully
  • Not post fake, misleading, or fraudulent listings
  • Not upload harmful, offensive, or copyrighted content
  • Not impersonate another person
  • Not use the app for illegal activities

Any violation may result in account suspension.

7. Communications Between Users

Buyers and sellers communicate directly (for example by phone or WhatsApp from a listing).

You are responsible for:

  • Protecting your personal information
  • Meeting safely in public locations
  • Inspecting the car
  • Ensuring payment safety

OTOZ is not involved in these interactions and is not responsible for communication issues or disputes.

8. Third-Party Content

Users may share information or links in listings or messages.

OTOZ is not responsible for:

  • The accuracy of this content
  • Any actions taken based on user-generated content

Use caution when interacting with other users.

9. App Permissions

To function properly, the app may request access to:

  • Camera — to take car photos
  • Photo Gallery — to upload car photos
  • Location — to show listings based on your area

You may disable permissions at any time, but some features may not work.

10. Modifications and Updates

We may update or modify the app at any time, including adding or removing features. We may also update these Terms. Continued use of the app means you accept the updated terms.

11. Limitation of Liability

To the maximum extent allowed by law:

  • OTOZ is not responsible for damages resulting from using the app
  • OTOZ is not responsible for fraud, scams, or disputes between users
  • OTOZ does not guarantee the accuracy of any listing
  • OTOZ is not liable for car condition, payment issues, or personal injury arising from buyer–seller meetings

You use the app at your own risk.

12. Termination

We may suspend or terminate your account at any time if:

  • You violate these Terms
  • You post false or fraudulent information
  • You misuse the app or engage in illegal activity

13. Intellectual Property

The OTOZ name, logo, app design, and content created by us belong to OTOZ. Users may not copy, reproduce, or use our trademarks without permission.

Content uploaded by users remains their responsibility.

14. Governing Law

These Terms are governed by the laws of Iraq. Any disputes shall be handled in the appropriate Iraqi courts.
